General travel terms and conditions of travel agency Bosnia Outdoor

  1. PRE-CONTRACTUAL NOTIFICATION:

By signing the standard Travel Contract – Confirmation of travel, with his/her signature on behalf of all travelers from the Contract (the Traveler) confirms that he/she has received the General Terms and Conditions, the travel program, that he/she has been familiarized with terms and Conditions same as all travelers from the Contract and that he/she fully accepts them, as well that he/she is familiarized with optional excursions and travel insurance

When “BOSNIA OUTDOOR” sells the arrangements of another travel organizer as a subagent, it is obliged to specify this on the Contract-Confirmation, in which case the general travel terms and conditions of the organizer apply.
When “BOSNIA OUTDOOR” sells the arrangements of another travel organizer as a subagent, it is obliged to specify this on the Contract-Confirmation, in which case the general travel terms and conditions of the organizer apply. Before concluding the Contract, the organizer can change the description of their services in the program at any time, and the traveler should be notified of these changes before concluding the Contract-Confirmation. By purchasing one of the arrangements, the traveler establishes a legal relationship with BOSNIA OUTDOOR. On the Contract-Confirmation, the traveler signs a clause (I am familiar with the general terms and conditions of travel) and by signing he/she accepts these conditions which represent the legal obligation for both the traveler and BOSNIA OUTROOR. If the Agency appears as a sub-agent of other travel organizer, i.e. if it sells the arrangement of other tour operators, it is obliged to introduce the traveler with the general travel terms and conditions of that organizer, in which case the general travel terms and conditions of the said apply.

  1. REGISTRATION AND PAYMENTS:

The traveler can register online, by e-mail or in person at the agency’s address. The registration is valid when the Contract-Confirmation is signed between the agency and the traveler, respecting the law on consumer protection and concluding distance contracts. When registering and signing the contract, the traveler is obliged to pay an advance in the amount of 40% of the price of the arrangement, and the rest of the payment to be made before the start of the arrangement, unless otherwise specified in the contract. If the traveler does not make the payment on time, the agency BOSNIA OUTDOOR reserves the right to terminate the contract and cancel the travel without refunding the advance payment.

  1. OBLIGATIONS AND RIGHTS OF THE ORGANIZER:
  • to conclude a Contract-Confirmation of travel with the traveler through a distance contract or at the agency’s premises,
  • to hand over to the traveler a written travel program and general travel terms and conditions,
  • to inform the traveler about the travel insurance offer,
  • to take care of the rights and interests of travelers.
  1. OBLIGATIONS AND RIGHTS OF THE ORGANIZER:
  • to get introduced in detail with the Program and General Terms and Conditions of Travel before signing the Contract, and to point out special requirements that are not covered by the published programs
  • to pay the agreed price under the conditions, deadlines and in the manner stipulated by the Contract
  • to provide the organizer in a timely manner with accurate and complete information, documents necessary for the organization of the travel and to guarantee that he/she, his/her documents and luggage, meet the requirements set by the regulations of our, transit and destination countries.
  1. TRAVEL ARRANGEMENT PRICE:

Prices for all travel arrangements are expressed in Convertible Marks (BAM), unless otherwise planned by the program. Prices are formed based on the business policy of the organizers and cannot be subject to complaints from travelers. The price from the Contract includes, a pre-prepared and published combination of at least two services; accommodation, food, transport services, preparation and organization of travel, for which services the travel program defines a single price.

The price of the travel arrangement does not include (unless otherwise defined by the Contract); airport taxes, port taxes, optional tickets, excursions, visa costs, room service, hotel doctor, telephone, air conditioning, and other services. All types of additional services (single room, additional meals, etc.) are paid by the traveler separately at the agency, and upon registration he/she is obliged to request the same to be included in the Contract-Confirmation.

  1. CHANGE OF THE PRICE OF THE TRAVEL ARRANGEMENT:

The organizer may request an increase in the agreed price, if after the conclusion of the Contract-Confirmation there has been a change in the exchange rate or a change in the carrier’s tariffs and in other cases stipulated by the law. An increase in the published price of 10% does not require the consent of the traveler, and the increase may relate only to the part of the services that has not already been paid by the traveler. If the price increase is more than 10%, the traveler has the right to terminate the contract by written statement without the obligation to compensate the Organizer, but no later than 48 hours from the submission of the report on the price change. If the traveler does not notify the organizer in writing within the specified period that he/she withdraws from the contract, it is considered that he/she agrees with the new price. Subsequent price reductions (e.g. last minute offer) cannot refer to already concluded Contracts and cannot be the basis of any complaint of the traveler towards the organizer.

  1. CATEGORIZATION AND DESCRIPTION OF SERVICES:

Accommodation facilities and accommodation units, means of transport and other services are described according to the official categorization of the domicile country, they are different and not comparable by destination, even within the same destination. The quality of the service depends primarily on the price of the arrangement, the chosen destination and the categorization determined by local-national regulations and are beyond the control of the organizers.
The start and end date of the travel, determined by the program, does not imply a full-day stay of travelers in the accommodation facility or destination. The time of arrival and departure of travelers, as well as entry or exit of travelers from the accommodation facility is conditioned by procedures at border crossings, road conditions, permits of competent authorities, technical and weather conditions or force majeure that may affect the departure time of aircraft and other means of transport, which the organizer cannot influence, and due to such cases the organizer is not responsible. The first and last day of the program are intended for travel and does not imply a stay in a hotel or destination but only mark the calendar day of the beginning and end of the travel, so the organizer is not responsible for evening, night or early morning flight, entering the room in the late evening. hours, leaving the hotel in the early morning and the like.

For air arrangements, the agreed start time of the travel is the meeting of travelers at the airport which is at least 2 hours prior to the first announced departure time by the airline. In case of moving the specified time of departure of the aircraft, the Organizer does not bear any responsibility, but national and international regulations in the field of air traffic apply. As a rule, departure-arrival, take-off-landing of the plane at charter flights is in the late evening or early morning hours and if, for example. Provided contracted initial or final meal in the form of the so-called “cold meal” outside or in the accommodation facility, it is considered that the Contract is fully executed.

For bus travel, the agreed start time of the travel is the meeting of travelers at the place of departure of the bus on the first day of travel, as a rule, 30 min. prior to the announced departure time. The agreed time of the end of the travel and the services of the travel organizer is considered to be the time of arrival of the bus on the last day of the travel to the place of departure or another place provided by the program.

The services of a tourist guide, escort, local guide, mountaineering guide do not imply their full-time and continuous presence, but only as provided by the program. The services of the local representative are contacts and necessary-necessary assistance to the traveler according to the pre-arranged periods of periodic duty published on the bulletin board or in another appropriate way.

  1. ACCOMMODATION, TRANSFER AND TRANSPORT:

The layout of the rooms is determined by the reception at the accommodation facility. The hotels on offer can be composed of several of the same or different accommodation facilities and accommodation units. If the traveler has not explicitly agreed accommodation of special features, he/she will accept any officially registered accommodation unit in the accommodation facility described in the travel program. Accommodation of travelers is at the earliest at 3 p.m. on the day of using the service, and leaving the facility no later than 10 a.m. on the day of using the service. The traveler is not entitled to a refund for arbitrary, or through his/her own fault caused by premature departure from the hotel, or the price of accommodation or transportation.

Accommodation in a single room is always on request and at an additional cost. Triple and quadruple accommodation units (rooms, studios and apartments) are in accordance with the categorization of the domicile country (extra beds are metal and wooden folding structures that can significantly worsen the quality of accommodation) and are not recommended for adults.

The organizer may change the contracted accommodation, without the consent of the traveler, to accommodation in the facility of the same or higher category at own expense, and accommodation in lower category facilities can be done with the consent of the traveler and refund the difference in price with a relatively reduced category of accommodation.
The variety and quality of food depends mainly on the price of the arrangement, the category of the facility, the destination, local customs, regardless of whether the service is based on the principle of self-service or serving (menu). The ALL INCLUSIVE or ALL INCLUSIVE LIGHT service, like any other, is subject to internal hotel rules and does not have to be identical within the same category at the same destination. Transportation by bus is performed by standard tourist buses according to the regulations and criteria that are valid in the country in which the carrier is registered that the agency or organizer hired. The agency has the right to hire all types of tourist buses that meet the conditions provided by the regulations on comfort, without prior notification of travelers. The seats in the bus are arranged when concluding the Contract in the agency. The route, breaks, place and length of their duration are determined by the driver-guide, who also has the right to change the timetable and itinerary due to unavoidable circumstances.

  1. TRAVEL DOCUMENTS, HEALTH AND LEGAL REGULATIONS:

Conditions published in the travel program for tourists coming to Bosnia and Herzegovina. A traveler arriving in BiH is obliged to respect customs obligations when crossing border crossings and to have valid documents, travel and health insurance and a visa if necessary. The tour operator does not accept responsibility when selling the package if the traveler acted contrary to this article.

All conditions published in the program for travel outside Bosnia and Herzegovina apply exclusively to citizens with a travel document of Bosnia and Herzegovina. The organizer is not responsible and is not obliged to inform travelers citizens of other countries on the conditions (visa, customs, health, etc.) that apply to the country of destination or transit, but the obligation of a foreign citizen to inform the competent consulate and the necessary conditions and documents provide timely and orderly.

A traveler traveling abroad must have a valid travel document and submit to the organizer the correct and complete necessary data and documents for obtaining a visa, if it is obtained by the organizer. The official of the organizing agency or intermediary is not authorized to determine the validity of travel and other documents and documents. When the organizer mediates in the process of submitting the documentation, he/she does not guarantee obtaining a visa or obtaining a visa on time and does not bear any responsibility for the malfunction of travel and other documents or if the border authorities or immigration services do not allow entry, transit or further stay. If the traveler loses his/her travel documents or is stolen during the travel, he/she is obliged to provide new ones in due time at his/her own expense and to bear all possible damages and consequences on that basis.

The traveler is obliged to arrange special services related to his/her health condition, such as specific nutrition, characteristics of accommodation, etc. due to chronic illness, allergies, disability, etc. otherwise the organizer does not assume any special obligation, responsibility or damage on that basis. For travels to countries where special rules apply, which include mandatory vaccination or the purchase of certain documents, the traveler is obliged to perform the necessary vaccinations and provide appropriate certificates and bears all the consequences and damage. The traveler is obliged to strictly respect customs, foreign exchange, etc. regulations of Bosnia and Herzegovina, transit and countries in which he/she resides, and in case of impossibility to continue the travel, i.e. stay and everything else, all consequences and costs are borne by the traveler. If the travel cannot be realized due to the traveler’s omission related to the provisions of this item, the provisions of item 10 of these conditions shall apply.

  1. CANCELLATION OF THE ARRANGEMENT BY THE TRAVELER:

The arrangement can be canceled only in person at the Agency or via the Internet if the contract-confirmation is signed via electronic business on the basis of a distance contract.

If the Agency acts as a subagent, the General Travel Conditions of the travel organizer apply.

If the Agency acts as a travel organizer, the traveler can cancel the travel under the following conditions:

  • for cancellation up to 30 days before the start of the arrangement, 5% of the price of the package per person is retained
  • for cancellation 29-20 days before the start of the arrangement, 10% of the price of the arrangement per person is retained
  • for cancellation 19-11 days before the start of the arrangement, 30% of the price of the package per person is retained
  • for cancellation 29-20 days before the start of the arrangement, 10% of the price of the arrangement per person is retained
  • for cancellation 29-20 days before the start of the arrangement, 10% of the price of the arrangement per person is retained
  • for cancellation up to 30 days before the start of the arrangement, 5% of the price of the package per person is retained

The same conditions apply to the change of the arrangement as to the cancellation of the arrangement. If the buyer of the arrangement gives it up after the start of the program, the full amount of the arrangement per person is retained. In case of unforeseen circumstances (death, illness …), the buyer is obliged to submit appropriate evidence. In such cases, the buyer does not pay compensation according to the specified scale, but only pays the actual or incurred costs to the agency.

  1. CANCELLATION AND CHANGE OF THE TRAVEL PROGRAM BY THE ORGANIZER:

The organizer may withdraw from the contract in whole or in part, in case of extraordinary circumstances which, if they existed at the time of publication of the program, would be a justifiable reason for the organizer not to publish the program and not conclude contracts, in case of insufficient number of registered travelers and other objective circumstances, which the organizer is obliged to inform the travelers no later than 5 days before the scheduled start of the travel, with the obligation to refund the paid funds to the traveler in full no later than 8 days from the date of cancellation.

Unless otherwise stated in the travel program, in order for the travel to be realized, the minimum number of registered travelers should be: for travel by bus 40 travelers, for travel on scheduled airlines in Europe 20 travelers, for travel on intercontinental airlines 15 travelers, for travel on specially agreed air charter lines and trains or hydrofoils at least 80% of capacity, for travel of foreign travelers coming to Bosnia and Herzegovina min. 4 to 8 travelers, unless otherwise concluded by the contract.
In case of complete withdrawal from the Contract, the organizer will try to offer the traveler an alternative travel program for the same or another destination, which the traveler accepts or rejects in writing within 24 hours. In case of acceptance of the new contract, the traveler waives any claims on any legal basis against the organizer on the basis of the originally concluded contract. The organizer before the start and during the travel, of which he is obliged to inform the traveler without delay in the most appropriate way, reserves the right to change the day or hour of the travel, as well as the right to change the itinerary and necessary changes of travel program (changed flight details, forced landing, vehicle breakdown, congestion at borders or in traffic, closure of a site intended for a tour, changes in the visa regime, security situation, natural disasters or other extraordinary and objective circumstances and force majeure) without obligation to pay damages or any other traveler fees. In these cases, the organizer bears any additional costs of changing the travel program. In case the started travel is interrupted for justified reasons, the organizer is entitled to compensation for the services actually performed.

  1. OBJECTIONS AND COMPLAINTS OF TRAVELLERS:

The traveler is obliged to inform the local representative, the organizer without delay on the spot, and if this is not available, directly to the organizer and the direct service provider (e.g. carrier, hotelier, etc.), to cooperate in good faith to eliminate the causes of the complaint and accept offered a solution that corresponds to the contracted service. If the cause of the complaint has not been remedied on the spot, the traveler draws up a written complaint in two copies with a representative of the organizer or service provider, signed by both. The traveler retains one copy of the complaint. If the cause of the complaint is removed on the spot, the traveler is obliged to sign a confirmation form, otherwise the fact that he/she continued to use the offered solution is considered that the travel program is fully executed. If the deficiencies are not remedied on the spot, the traveler is obliged to submit a justified and documented written complaint (confirmation of complaint, invoices for paid additional costs, request for types of unperformed services), concretized and quantified, exclusively to the organizer within 8 days after the end of the travel in relation to each traveler individually and other evidence) and demand a refund of the difference in price. Each traveler who signs the contract in his/her own name and on behalf of the person from the contract or a person with a proper power of attorney, submits a complaint individually, because the organizer will not consider group complaints. The organizer is obliged to take into the procedure only timely, reasoned and documented complaints, the cause of which could not be eliminated during the travel on the spot. The organizer is obliged to deliver a written answer to the traveler within 8 days, or within 15 days from the date of receipt of proper documentation, the traveler is paid the difference in price.

If the complaint is not complete and needs to be edited, the organizer will provide the traveler with an answer to edit it within the set deadline under the threat of omission. The organizer will, in accordance with good business customs, and within the legal deadline, respond to the traveler with complaints that are untimely, unfounded or untidy. The reduction of the price according to the traveler’s complaint can reach only the amount of the complained and unperformed part of the service, it cannot include the already used services, nor can it reach the amount of the entire price of the travel program. The amount of compensation, which is paid upon a well-founded and timely complaint, is proportional to the degree of unperformed, i.e. partially performed service. If the traveler accepts the payment of compensation in the name of a proportional reduction of the price, or any other type of compensation, it is understood that he/she agrees with the proposal of the organizer for a peaceful settlement of the dispute, and thus waives all further claims against the organizer, regardless to the fact whether he/she signed a written confirmation of the reimbursement with a clause on the final resolution of mutual disputes. It will be considered that the refund of the difference in price to the traveler has been made and an agreement has been reached with the traveler in accordance with the law and these general conditions, when the organizer offered the traveler a real difference in price for inadequately rendered services. conclusion of a travel contract, and other available evidence, and that the organizer acted in accordance with the positive regulations. Any request of traveler to initiate proceedings before the competent authorities before the deadline for resolving complaints or reclamations will be considered premature, as well as informing the media and media, a violation of the contract and these general conditions.

  1. LIABILITY INSURANCE:

Travel agency “BOSNIA OUTDOOR” provided a guarantee in the form of an insurance policy with the insurance company Wiener Insurance, as follows: (POLICY NUMBER 5.027.619) for:

Insurance of the contracted liability of the travel organizer – for damages caused to the traveler by non-fulfillment, partial fulfillment or irregular fulfillment of obligations related to the package deal, determined by the General Travel Terms and Conditions and travel program, per harmful event up to 10.000,00 BAM
  2. Insurance of general, non-contractual liability of the travel organizer towards third parties – for the amount of insurance with an aggregate limit of 10.000,00 BAM
  1. PROTECTION OF TRAVELLERS’ PERSONAL DATA:

Personal data of travelers, which he/she provides voluntarily, represent a business secret of the Organizer. The traveler agrees that the Organizer may use personal data for the realization of the agreed travel program, whereby the addresses, place, time and price of the travel and the names of the companions cannot be communicated to other persons, except to persons specified by special regulations.

  1. OBLIGATORY APPLICATION:

The Organizer may envisage different provisions in relation to these General Terms and Conditions by the Program or Special Travel Conditions, due to special conditions and rules of direct service providers, as well as for travels with special contents (on the occasion of sports, congress and similar international events and special types of tourism – hunting and fishing, extreme sports, etc.) and which form an integral part of such Contracts. The inefficiency of certain provisions of the Contract does not result in the inefficiency of the entire Travel Contract, which also applies to these General Terms and Conditions.

  1. COVID 19

Since the outbreak of the corona virus, the agency Bosnia Outdoor has been respecting all measures and recommendations of the Ministry of Health and Social Welfare, the Institute of Public Health and Civil Protection.

  • Obligatory observance of the allowed number of persons indoors up to a maximum of 50 persons
  • When entering countries where the Covid 19 test is mandatory, it is at the expense of travelers / tourists
